Adam Davis to present at Marine Industry Day on USCG sexual misconduct reporting requirements

Adam Davis will panel a discussion at Marine Industry Day for the New Orleans Harbor Safety Committee to discuss recent changes to federal law concerning U.S. Coast Guard sexual misconduct and harassment reporting requirements. Industry Day is scheduled for June 22, 2023 at the Higgins Hotel in New Orleans.


46 U.S. Code § 10104 now requires vessel owners and masters to immediately report harassment, sexual harassment or sexual assault violations of employer policy or law to the U.S. Coast Guard. Information in the initial report must include:

  • Identity of person making the report, his/her relation to the vessel and contact information.

  • Name and official number of vessel

  • time and date of incident

  • geographic location of accident

  • brief description of the alleged sexual assault or harassment.

Within 10 days, vessel owners and masters must then submit a document describing actions taken, including the results of any investigation and any actions taken against the offending individual.


Failure to timely report can expose vessel owners and masters to at $50,000 fine and other liabilities.
